Having found the subject matter of the action to be arbitrable, the appeal court ought to have granted a stay of the proceedings pending reference of the dispute to arbitration.
In this case, however, the appeal court held that insofar as an irregularity has been committed, it had not been so fundamental as to vitiate the trial proceedings.
