Wesentliche Ergebnisse Das wesentliche Ergebnis der o.g. Abhandlung ist, dass sich das Vorsorgeprinzip innerhalb der letzten zwei Jahrzehnte von einem ursprünglich politischen Leitprinzip hin zu einer Norm des Völkergewohnheitsrechts in den Bereichen Meeresverschmutzung und Erhaltung und Bewirtschaftung von Lebenden Meeresressourcen entwickelt hat.
Es wird aufgezeigt, dass das Vorsorgeprinzip als Gewohnheitsrechtssatz in seinem Kerngehalt als Mindeststandard dem Wortlaut des Prinzips 15 der Rio Erklärung entspricht.
Zudem wird aufgezeigt, dass eine im Vordringen befindliche Staatenpraxis die Anwendung des Vorsorgeprinzips auch einer Verhältnismäßigkeitsprüfung unterzieht, die zumindest eine Kosten-Nutzen-Rechnung beinhaltet.

This thesis demonstrates that as a minimum standard the precautionary principle as a rule of customary international law is best reflected in Principle 15 of the Rio Declaration.
