Holding Privilege
Dividend payouts by a foreign subsidiary to an Austrian parent company may be tax exempt in Austria if certain conditions are met (10% share, 1 year holding period), according to the nesting privilege (“Schachtelprivileg“) of the Austrian Corporate Tax Law.
While these payouts may be tax exempt in Austria, they may be subject to a capital gains tax between 5% and 25% due to an existing DTA with the country where the subsidiary is located, or, due to the lack thereof.

Die Ausschüttung von Dividenden durch eine ausländische Tochtergesellschaft an ihre österreichische Muttergesellschaft wird unter bestimmten Voraussetzungen (10% Beteiligung, 1 Jahr Behaltefrist) in Österreich steuerfrei gestellt („Internationales Schachtelprivileg“ des österreichischen Körperschaftsteuerrechts).
Solche Beteiligungserträge sind zwar in Österreich steuerfrei, es kann aber auf Grund eines bestehenden DBA oder des Fehlens eines solchen vom Sitzstaat der Tochter eventuell eine 5- bis 25%ige Quellensteuer einbehalten werden.
